Terms of Service & End User License Agreement

These Terms of Service ("Terms") govern your use of the bar catering inquiry form and booking services provided by Boiler Room Bar Catering ("Boiler Room," "we," "our," or "us"), located in Fargo, North Dakota. By submitting an inquiry or entering into a service agreement with Boiler Room, you agree to these Terms.

1. Use of Our Inquiry Form

Our online inquiry form is provided for the sole purpose of submitting bar catering service requests. By submitting the form, you confirm that the information provided is accurate and complete. You agree not to submit false, misleading, or fraudulent information.

2. No Guarantee of Availability

Submission of an inquiry form does not constitute a confirmed booking. Your event date is not reserved until a signed contract and booking deposit have been received by Boiler Room. We reserve the right to decline any inquiry at our discretion.

3. Booking Deposit & Payment

A non-refundable booking fee of $115.00 is required to secure your event date. This fee covers the required liquor license, event insurance, and one licensed bartender. The remaining balance is due at the conclusion of the event. All payments are non-refundable in the event of cancellation for any reason.

4. Minimum Spend Requirement

All bar catering events are subject to a minimum spend requirement, calculated as follows: number of guests of drinking age multiplied by hours of service multiplied by $2.50, with a minimum of 50 guests and 2 hours. The maximum minimum spend is capped at $7,500. Any difference between actual spend and the minimum spend requirement will be billed at the conclusion of the event.

5. Alcohol Service

Boiler Room operates in full compliance with all applicable North Dakota state and local laws governing the service and sale of alcohol, including dram shop liability statutes. We reserve the right to refuse service to any guest who is underage, unable to provide valid identification, or appears intoxicated. Boiler Room does not hold an off-sale liquor license; unused pre-purchased product cannot be removed from the premises at the conclusion of the event.

6. Limitation of Liability

Boiler Room shall not be held liable for the actions or behavior of event guests before, during, or after the event. The client assumes full responsibility for ensuring that guests consume alcohol responsibly and that no alcohol is provided to minors. Boiler Room's total liability for any claim arising from its services shall not exceed the total amount paid by the client for those services.

7. Cancellation Policy

All payments made to Boiler Room, including the booking fee and any pre-paid amounts, are non-refundable. In the event of cancellation by the client for any reason, no refund will be issued. In the unlikely event that Boiler Room must cancel due to circumstances beyond our control, we will make every effort to reschedule the event or apply the booking fee as a credit toward a future event.

8. Use of Personal Information

By submitting an inquiry, you consent to the collection and use of your personal information as described in our Privacy Policy. Your information will be used solely to process your inquiry, prepare event documents, and manage your booking.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Dakota. Any disputes arising under these Terms shall be resolved in the courts of Cass County, North Dakota.

10. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after any changes constitutes your acceptance of the updated Terms.
